Hello: You have done your homework! 😎 It sounds like the contacts in the upper thermostat have welded themselves together and it will not switch power down to the lower element as it should. Perhaps this is because there is moisture? Do look for any signs of leakage, but go ahead and replace the upper thermostat. I’ll suggest you splurge and get an inexpensive analog volt ohm meter. You need more meter than you have to be able to know what your heater is doing. The ohm function, for instance, will tell you exactly how those elements are doing without having to unscrew them, and that’s nice.

I would get a match so you will have a good fit for the thermostat and cover piece. Do follow the wiring to make sure everything goes back where it should. The relief valve may have been compromised by all this activity too :?.
